Este estudo tem o propósito de investigar se o direito à identidade cultural é reconhecido pelo direito constitucional brasileiro, e a relação – de tensão e conformação – que estabelece com a cultura jurídica do país. A Constituição brasileira de 1988 é o grande marco normativo para tal exame. Antes dela, prevaleceu um conceito colonial, eurocêntrico e hegemônico de cultura, que subalternizava negros e índios e suas manifestações culturais. A nova Constituição expressa um compromisso com a igualdade, o multiculturalismo e a inclusão. Pergunta-se: qual é o resultado do encontro das novas normas e paradigmas com as antigas hierarquias sociais e suas estruturas?
ABSTRACT
This study aims to investigate whether the right to cultural identity is recognized by the Brazilian constitutionalism, and the relationship – of tension and conformation – that it establishes with the country´s legal culture. The 1988 Brazilian Constitution is the major normative framework for such enquire. Before its enactment, a colonial, Eurocentric and hegemonic concept of culture prevailed, devaluing black and indigenous people and their cultural manifestations. However, the new constitutional text expresses a commitment to equality, multiculturalism and inclusion. Our question is: what is the result of the clash between the new norms and paradigms and the old social Brazilian hierarchies and their structures?
