La presente investigación tiene como objetivo estudiar la preeminencia de lo social sobre lo indemnizatorio en los salarios caídos en Venezuela. Se abordan cuatro aspectos: De dónde surge el estudio; el salario, definiciones e interpretaciones; los salarios caídos y su fundamento legal; y finalmente, el criterio jurisprudencial sobre el salario. La metodología es documental y a nivel descriptivo. Es posible afirmar, que los salarios caídos son una obligación dineraria que surge unilateralmente para el patrono como consecuencia de la ruptura abusiva de la relación de trabajo, a modo de contraprestación efectiva indemnizatoria, que garantiza el derecho inherente al trabajador de ser resarcido por el daño que se le puede haber ocasionado en esa situación.
Abstract
The present research aims to study the preeminence of the social over compensatory in the wages fallen in Venezuela. Four aspects are addressed: Where the study arises; the salary, definitions and interpretations; fallen wages and their legal basis; finally, the jurisprudential criterion of salary. The methodology is documentary and descriptive. It is possible to affirm that the fallen wages are a monetary obligation that arises unilaterally for the employer as a result of the abusive rupture of the employment relationship, as an effective compensatory compensation that guarantees the inherent right to the worker to be compensated for the damage that is it may have caused you in that situation.
